Summary: The complainant requested legal advice from the Planning Inspectorate, an executive agency of the Department for Communities and Local Government (-the authority-) on the subject of the suitability of the Householder Appeal Service (-HAS-) for the consideration of applications for vehicle access. The authority refused to supply the information, citing the exception under regulation 12(5)(b) of the Environmental Information Regulations 2004 (-the EIR-). The Commissioner-s decision is that the authority correctly withheld the information using regulation 12(5)(b). The Commissioner does not require any steps to be taken.
