Summary: The complainant requested a report prepared by the Major Projects Authority about the plan to develop a high speed rail network (HS2). The Cabinet Office initially refused to disclose this information under FOIA. The Commissioner found that the request should have been considered under the Environmental Information Regulations (EIR). The Cabinet Office had also, in the alternative, cited the exception provided by regulation 12(4)(e) (internal communications) in the EIR. The Commissioner-™s decision is that the Cabinet Office incorrectly applied regulation 12(4)(e) -“ the public interest in maintaining the exception does not outweigh the public interest in disclosure. The Commissioner requires the Cabinet Office to disclose the withheld PAR report.
