Leeds City Council (Decision Notice) [2013] UKICO FER0470029 (13 May 2013)

Summary: The complainant submitted a request to Leeds City Council (the Council) for a copy of the contract between it and an external contractor in relation to the provision of street lighting. The Council disclosed a copy of the contract but explained that certain parts had been redacted on the basis of regulation 12(5)(e), the confidentiality of commercial information exception. The Commissioner has concluded that the redacted information is exempt from disclosure on the basis of regulation 12(5)(e). However, the Commissioner has also concluded that the Council breached regulations 7(1) and 11(4) because it failed to respond to the request within 40 working days and also failed to complete its internal review within the same timeframe, ie 40 working days.
