Summary: The complainant has requested information relating to a planning enforcement notice issued by Ashford Borough Council (the -council-) in relation to a property owned by the complainant. The council provided some of the requested information but withheld some information under the exception for adverse effect to the course of justice (regulation 12(5)(b)). The Commissioner-s decision is that the council has correctly applied regulation 12(5)(b) to the requested information and that, in this case, the public interest favours maintaining the exception. The Commissioner does not require the public authority to take any steps.
