Summary: The complainant requested information to show how the Home Office handled a previous information request. The Home Office provided some information but withheld other information under sections 36(2)(b)(ii), 36(2)(c), 40(1), 40(2) and 42 of the FOIA. The Commissioner-™s decision is that the Home Office was entitled to rely on the exemptions at sections 36(2)(b)(ii), 40(1), 40(2) and 42 of the FOIA in respect of most of the withheld information. However the Commissioner requires that some information be provided to the complainant. The Commissioner requires the public authority disclose the information identified in the confidential schedule. This decision notice is currently under appeal to the Information Tribunal.
