Summary: The complainant requested information about an investigation into the Headteacher of a particular school. Wiltshire Council (-˜the Council-™) withheld the information requested under section 40(2). During the course of the Commissioner-™s investigation the Council disclosed some information but maintained that the remaining information was exempt under section 40(2) of the FOIA. The Commissioner-™s decision is that the Council has correctly applied section 40(2) to the remaining information held relevant to the request. He does not require any steps to be taken.
