Summary: The complainant has made a series of information requests arising from a -Safe and Sustainable- review of paediatric cardiac surgery. The National Specialised Commissioning Team (NSCT) responded by claiming that it was not under a duty to comply with the requests because the cost of doing so when aggregated together would exceed the appropriate limit for the purposes of section 12(1) of FOIA. The Commissioner-s decision is that the NSCT properly applied section 12(1) of FOIA. He does not therefore require the NSCT to take any steps as a result of this notice.
