Summary: The complainant requested information from the Department for Education relating to Free School proposals received in 2013 for opening in September 2014. The Department for Education initially withheld the information under section 36(2) of the FOIA but during the course of the Commissioner-™s investigation made it available on its website. The Commissioner-™s decision is that the Department for Education did not deal with the request in accordance with the FOIA. The information was not supplied within 20 working days and therefore the Department for Education breached section 10(1). As the requested information was provided during the course of the Commissioner-™s investigation he does not require the Department for Education to take any further action.
