Summary: The complainant has requested the raw scores required to attain specified standard scores on grammar school application tests from Wirral Metropolitan Borough Council (-the council-). The council refused the request citing section 40(2) of the FOIA. The Commissioner-s decision is that section 40(2) of the FOIA is not engaged, and therefore cannot be used to withhold the information. The Commissioner also identified that the council issued a refusal notice outside of 20 working days, and therefore breached section 17(1). The Commissioner requires the council to disclose the withheld information, after first redacting information that confirms whether or not children in each cohort attained a specific standard score.
