Summary: The complainant submitted a request to the London Borough of Southwark (the Council) for the cost of repainting double yellow lines on a particular street. The Council withheld this information under section 43(2) of FOIA on the basis that disclosure would prejudice both its interests and those of its contractor who carried out the work. The Commissioner is satisfied that disclosure of the withheld information would result in prejudice to the contractor-™s commercial interests and furthermore would be likely to prejudice the Council-™s commercial interests. The information is therefore exempt from disclosure on the basis of section 43(2) of FOIA. The Commissioner has also concluded that the public interest favours withholding the information.
