The complainant has requested information from Staffordshire Moorlands District Council (SMDC) about its compliance with the Aarhus Convention Treaty in relation to the Core Strategy and Churnet Valley Masterplan. SMDC refused to respond to the request relying on section 14(1) of the Freedom of Information Act as it deemed the request to be vexatious. It is the Commissioner’s position that SMDC should have considered the request under the Environmental Information Regulations 2004 (EIR). The Commissioner therefore considered regulation 12(4)(b) which relates to requests deemed to be manifestly unreasonable. The Commissioner’s decision is that SMDC has correctly applied regulation 12(4)(b) to the request. The Commissioner does not require the public authority to take any steps.
