Summary: The complainant has requested information relating to the ownership of land referred to in the -Play Provision in Barton on Sea- report. New Forest District Council stated that it did not hold the requested information. The Commissioner-s decision is that New Forest District Council: wrongly handled the request under the FOIA and failed to issue a proper refusal notice, breaching regulation 14 of the EIR; correctly confirmed that it does not hold the requested information and, in doing so, complied with regulation 5 of the EIR. The Commissioner does not require the public authority to take any steps.
