The complainant has requested from Sandwell Metropolitan Borough Council (‘the council’) dataset budget information for all schools. The council initially refused the request citing the exemption for information accessible to the applicant by other means at section 21 of the FOIA. On internal review, the council revised its response to state that the information is not held for the purposes of the FOIA. The Commissioner’s decision is that the council has not provided sufficient reasons for stating that the information is not held for the purposes of the FOIA. The Commissioner requires the council to issue a fresh response to the complainant without stating that the information is not held for the purposes of the FOIA, taking into consideration section 11 of the FOIA, as amended by section 102 of the Protection of Freedoms Act 2012, as the information has been requested in a specific format.
