The complainant requested various items of information in respect of the disciplinary process of two named employees of Aberystwyth University. The University provided some information, confirmed that it did not hold a small amount of other information but withheld the bulk of the requested information by virtue of section 40(2) of the FOIA. The Commissioner’s decision is that the University correctly relied on section 40(2) of the FOIA. However, the University’s failure to consider this request under the FOIA has resulted in a breach of section 1(1), section 10 and section 17(1) of the FOIA. The Commissioner does not require the University to take any steps.
