The complainant has requested information regarding legal matters referring a specific road. Nottinghamshire County Council refused the request under the exception for adverse affect to the course of justice (regulation 12(5)(b) of the EIR). The Commissioner’s decision is that Nottinghamshire County Council: failed to issue a valid refusal notice in time and breached regulation 14(2) of the EIR and; correctly applied regulation 12(5)(b) to withhold the requested information and that the public interest favours maintaining the exception. The Commissioner does not require the public authority to take any steps.
