The complainant has requested a copy of an investigation report regarding a certificate issued by South London and Maudsley NHS Trust (“the Trust”) to a UK Specialist Ambulance Service. The Trust refused the request on the basis it considered the entirety of the report to be the personal data of a third party (section 40(2)). In addition to this the Trust also considered sections 31 and 36 of the FOIA provided a valid basis for withholding the requested information. The Commissioner’s decision is that section 31(1)(g) with 31(2)(a),(b) and (c) is engaged and the public interest favours maintaining the exemption.
