The complainant has requested information relating to the refurbishment of the Futurist theatre in Scarborough. The Commissioner’s decision is that, on the balance of probabilities, Scarborough Borough Council does not hold the requested information. He has also decided that Scarborough Borough Council breached the statutory time for compliance at section 10(1) of the FOIA. He does not require the council to take any steps to ensure compliance with the legislation.
