The complainant has requested information relating to the number of appliances available during periods of industrial action in Norfolk Fire and Rescue Service. The Commissioner’s decision is that Norfolk County Council is not entitled to rely on the exemption for health and safety at section 38 of the FOIA as a basis to withhold the requested information. The Commissioner requires the public authority to disclose the requested information to ensure compliance with the legislation.
