The complainant has requested specific information relating to a planning application near his property. The council responded to say that having searched for the requested information, it had concluded that it was not held. However, during the course of the Commissioner’s investigation the information was located and provided. The Commissioner’s decision is that the council has failed to comply with regulation 5(2) as information within the scope of the request was provided outside the required 20 working day time frame. As the information has now been provided, the Commissioner does not require the council to take any steps in this case.
