The complainant requested certain information following his appeal of a previous FOIA request to the First Tier Tribunal. The Ministry of Justice (the ‘MOJ’) initially refused to provide the requested information on the basis of section 21 (information reasonably accessible by other means), but later relied on section 32 (court records). The Commissioner’s decision is that the MOJ has correctly relied on section 32(1)(a) to withhold the requested information. He does not require the MOJ to take any steps.
