The complainant has requested information relating to a fatal motorway crash including details of the signage in place and the status of the hard shoulder at the time of the accident. Highways England considered this information exempt on the basis of section 31(1)(a) and (c). The Commissioner’s decision is that Highways England has correctly relied upon the section 31(1)(a) exemption and the balance of the public interest favours maintaining the exemption. He requires no steps to be taken.
