The complainant has requested information connected to a person convicted of murder from the Metropolitan Police Service (the “MPS”). The MPS refused to provide some information citing sections 40(2) (personal information) and 30(1)(a)(i) (investigations) of the FOIA. It would neither confirm nor denying holding the remainder by virtue of sections 30(3), 40(5) and 31(3)(law enforcement). The Commissioner’s decision is that section 40(2) is properly engaged. He also finds that 30(3) is engaged and that the public interest against confirmation or denial that information is held outweighs that in favour of confirmation or denial. He requires no steps.
