3 September 2015, Education (School)
The complainant has requested information from St Ronan’s Primary School (“the School”) in relation to Board of Governors meetings and policies. The School provided him with some information, however he complained to the Commissioner as he believed that more information within the scope of his request should have been held by the School. The Commissioner’s decision is that, on the balance of probabilities, the School does not hold any further information within the scope of the complainant’s request other than that which has already been provided to him. Therefore, the School has not breached section 1(1) of FOIA. However, the Commissioner finds that the School has breached section 10(1) of FOIA as it failed to respond to the complainant’s request within the 20 working day statutory time limit. Since the complainant has now been provided with the information which the School does hold, the Commissioner does not order any steps to be taken.
FOI 1: Not upheld FOI 10: Upheld
