The complainant requested the names of the nurses overnight on a date in 2013 at Burton Hospitals NHS Foundation Trust (the Trust). The Trust withheld the information, citing the exemption under section 40(2) of the FOIA (third party personal data) as its basis for doing so. The Commissioner’s decision is that the Trust has correctly applied this exemption and does not require the Trust to take any steps.
