The complainant requested a breakdown of credit balances owed to ratepayers that had been accrued by the council. The Commissioner’s decision is that the council incorrectly applied the exemptions at s31 and s41 in order to withhold the information. He requires the public authority to disclose the withheld information to the complainant within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
