The complainant has requested information relating to an alleged assault. North Yorkshire Police withheld the information under section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that North Yorkshire Police should have neither confirmed nor denied holding the requested information by virtue of section 40(5) of the FOIA. The Commissioner does not require North Yorkshire Police to take any further steps as a result of this decision.
