The Ministry of Justice (MoJ) refused to either confirm or deny holding information within the scope of the request citing sections 40(5) (personal information) and 32(3) (court records) of FOIA. The Commissioner’s decision is that the MoJ was correct to neither confirm nor deny holding information within the scope of the request. The Commissioner requires no steps to be taken.
