The complainant requested information about named persons she believed to be associated with, or employed by, Kent Police. The police refused to confirm or deny holding the information requested, relying on the exemption at section 40(5) (personal data) of the FOIA. The Commissioner’s decision is that the police had cited section 40(5) correctly and so were not obliged to confirm or deny whether the requested information was held. No steps are required. This decision notice is currently under appeal to the Tribunal.
