The complainant requested information relating to officers issued with misconduct / gross misconduct notices. Lincolnshire Police provided some information within the scope of the request but refused to provide the remainder citing section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that Lincolnshire Police is entitled to rely on section 40(2) and is not obliged to disclose the withheld information. The Commissioner requires no steps to be taken as a result of this decision.
