The complainant has requested information relating to Liverpool City Council’s decision to pay the legal costs incurred by the Mayor in a dispute with his previous employer. The council disclosed some information and withheld other information under the exemption for Legal Professional Privilege – Section 42 of the FOIA. The Commissioner’s decision is that Liverpool City Council has breached section 17 and correctly applied section 42 to withhold legal advice falling within the scope of the request. The Commissioner does not require the public authority to take any steps.
