The complainant has requested information from Kirklees Metropolitan Council (“the Council”) about communications between the Council and the Crown Prosecution Service (“the CPS”) in relation to given building addresses. The Council applied the exemption provided by section 40(5) of the Freedom of Information Act (“the FOIA”). The complainant subsequently contested the Council’s application of this exemption. The Commissioner’s decision is that the Council has correctly applied the exemption provided by section 40(5). The Commissioner does not require any steps to be taken.
