The complainant had requested information held by Guilford Borough Council (the council) relating to the Local Plan and route options for access to a proposed development. Whilst the council provided the complainant with some details, it withheld the majority of the relevant informaiotn under regulation 12(4)(d) (material still in the course of completion), regulation 12(5)(e) (confidentiality of commercial or industrial information, and regulation 12(5)(f) (interests of the person who provided the information). The Commissioner’s decision is that the council has correctly applied regulation 12(4)(d) of the EIR to all the withheld information and the public interest favours maintain the exception in this instance. The Commissioner does not require the public authority to take any steps as a result of this decision notice.
