The complainant submitted a request to the public authority for a copy of the financial viability assessment undertaken on a piece of land purchased by the public authority. The public authority disclosed most of the financial viability assessment. It withheld the remaining information within the scope of the request in reliance on the exception at regulation 12(5)(e) EIR. The Commissioner has concluded that the public authority was not entitled to rely on the exception at regulation 12(5)(e).
