The complainant requested information from the London Borough of Hackney in relation to its decision to apply for planning permission to build a temporary school at Audrey Street Park Depot E2 8QH. The London Borough of Hackney withheld the information under Regulation 12(4)(b) of the EIR. The Commissioner’s decision is that the London Borough of Hackney has correctly applied Regulation 12(4)(b) of the EIR. The Commissioner does not require the public authority to take any steps to ensure compliance with the legislation.
