The complainant requested information relating to an alleged assault in which he was involved. West Midlands Police refused to confirm or deny holding the requested information citing section 40(5) of the FOIA (personal information). The Commissioner’s decision is that the section 40(5)(a) exemption is engaged. The Commissioner does not require West Midlands Police to take any steps as a result of this decision. This decision notice is currently under appeal to the Tribunal.
