The complainant has requested information concerning the identity of a former councillor who had been in arrears of his/her council tax payments during his/her period of office. The Council has withheld this information in reliance on section 40(2) of the FOIA on the grounds that it is the ex-councillor’s personal data and it would be unfair to the ex-councillor to place this information into the public domain. The Commissioner’s decision is that East Riding of Yorkshire Council has correctly applied section 40(2) of the FOIA to the information it is withholding from the complainant.
