The complainant has requested the council to disclose all emails from the Head of Parking Services’ email account over a 6 month period which contain both the words “PCN” and “target” and “PCN” and “bonus”. The council refused to comply with the request citing section 14(1) of the FOIA. The Commissioner’s decision is that section 14(1) of the FOIA does not apply in this case. The Commissioner therefore requires the council to issue a fresh response under the FOIA which does not rely on section 14(1).
