The complainant has requested information from the Western Health & Social Care Trust (“the Trust”) in relation to the Trust’s dental department. The Trust disclosed most of the requested information to the complainant, however it refused to disclose the remainder, citing section 40(2) of the FOIA as a basis for non-disclosure. The Commissioner’s decision is that the Trust has correctly applied section 40(2) of the FOIA to the withheld information and therefore the Commissioner requires no steps to be taken.
