The HO advised that it did not hold some of the information (which was not disputed) and that the remainder was exempt by virtue of section 35(1)(a) (formulation of government policy, etc). The Commissioner’s decision is that the exemption at section 35(1)(a) is only partially engaged and, where it is engaged, that the public interest favours disclosure. The Commissioner requires the HO to disclose the withheld information.
