The complainant submitted a request to the Competition and Markets Authority (CMA) for information concerning a referral made to it by the Competition Appeal Tribunal. The CMA refused to confirm or deny whether it held any information falling within the scope of the request on the basis of section 32(3) (court records) of FOIA. The Commissioner has concluded that the CMA is entitled to rely on section 32(3) and is not obliged to confirm or deny whether it holds any information falling within the scope of the request.
