The complainant has requested information relating to the ICO’s intention to amend her guidance on the application of section 36 of the FOIA. The ICO disclosed some information but withheld other information, citing section 42 of the FOIA. The Commissioner’s decision is that section 42 of the FOIA is engaged and that the public interest in favour of disclosure is outweighed by the public interest in maintaining the exemption in this case. She therefore does not require any further action to be taken.
