Basingstoke and Deane Borough Council withheld information on the basis of regulation 12(5)(e) - commercial confidentiality and regulation 12(4)(b) – manifestly unreasonable on the grounds of cost. The Commissioner’s decision is that Basingstoke and Deane Borough Council has correctly applied regulation 12(5)(e), 12(4)(b), and the requirement of regulation 9(1) to provide advice and assistance. The Commissioner does not require the public authority to take any steps.
