Hambleton District Council

The complainant has requested a copy of a viability assessment and associated District Valuer report relating to the Sowerby Gateway Development. Hambleton District Council withheld the requested information under the exception for commercial confidentiality – regulation 12(5)(e) of the EIR. The Commissioner’s decision is that Hambleton District Council has failed to demonstrate the regulation 12(5)(e) is engaged. The Commissioner requires the public authority to disclose the requested information. This decision notice is currently under appeal to the Tribunal.
