Local Government & Social Care Ombudsman

The complainant has requested information associated with a complaint he had submitted to the Local Government & Social Care Ombudsman (LGO) about Eden District Council. LGO withheld the majority of the information under section 40(1) of the FOIA as it is the complainant’s own personal data.  It released this information to the complainant under the Data Protection Act, having redacted the personal data of third persons.  LGO has withheld some information under section 44(1)(a) of the FOIA (prohibitions on disclosure). The Commissioner’s decision is that: LGO is entitled to rely on section 44(1)(a) with respect to the information it has withheld under this exemption. The Commissioner does not require LGO to take any steps.
