East Riding of Yorkshire Council

The complainant has requested information from the council relating to the ownership of a lane in the county. The council argues that the request is vexatious given the previous history of requests and correspondence between the parties. It therefore initially applied section 14 of FOIA but amended this to apply Regulation 12(4)(b) of the EIR during the course of the Commissioner's investigation of the complaint. The Commissioner’s decision is that the council was correct to apply Regulation 12(4)(b) to the information. The Commissioner does not require the council to take any steps.
