Ministry of Justice

The complainant requested information from the Ministry of Justice (MoJ), including information relating to the pay and gender of prison staff working in a particular department. The MoJ confirmed it held the requested pay and gender information. However, it refused to disclose it, citing section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that the MoJ is entitled to rely on section 40(2) and is not obliged to disclose the withheld information. The Commissioner requires no steps to be taken as a result of this decision. This decision notice is currently under appeal to the Tribunal.
