Hartlepool Borough Council

The complainant has requested information about an Economic Viability Assessment. Hartlepool Borough Council disclosed some information, and withheld the remainder under regulations 12(5)(e) and 12(5)(f). The Commissioner’s decision is that the Council has failed to demonstrate that regulations 12(5)(e) and 12(5)(f) are engaged. The Council has also breached the requirement of regulation 5(2). The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: Disclose the withheld information. Information Tribunal appeal EA/2019/0288 under appeal.
