East Woodhay Parish Council
The complainant has requested all information and documents relating to a certain cricket ground and club. He has also requested all information regarding activities or plans concerning the allocation of funds within the ward which would affect the cricket club and ground from East Woodhay Parish Council (“the Council”). The Council states that it has provided all of the information it holds and it does not hold any further information surrounding the scope of the complainant’s request. During the course of the Commissioner’s investigation, the Council had discovered further information that the clerk had recently gained access to and that was not provided at the point of responding to the request. The Commissioner’s decision is that the Council has breached regulation 5(1) and 9(2) of the EIR. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: Provide a fresh response to the request; and provide the complainant with advice and assistance to help refine the request in line with regulation 9(2) of the EIR.
