Hertsmere Borough Council

The complainant has requested information from Hertsmere Borough Council in relation to complaints received about a farm.  Hertsmere Borough Council withheld the information under the exception for the course of justice – regulation 12(5)(b) of the EIR.  The Commissioner’s decision is that Hertsmere Borough Council has correctly withheld the information under regulation 12(5)(b) and that the public interest favours maintaining the exception.  The Commissioner does not require the public authority to take any steps. Information Tribunal appeal EA/2020/0071 under appeal.
