The complainant has requested access to the closed document FCO 37/3978. The National Archives (TNA) cited the exemptions provided by section 27 – international relations, section 40(2) third party personal data and section 41(1) information that was given in confidence to refuse the withheld information. During the investigation, TNA considered that section 23 or 24 (security matters) of the FOIA also applied to some of the information in the file. The Commissioner’s decision is that TNA is entitled to rely on the exemption provided by section 27(1) to withhold the information. Her full position is set out in a confidential annex which will be provided to TNA only.
